Hey! Thanks for using GamersHut. We’ve tried to write these terms in plain English. If something’s unclear, email us at [email protected] and we’ll explain it.
The Short Version
- You pay $20/month, we provide you private game servers.
- You and up to 4 friends can access servers across all our supported games.
- You need to own the games yourself. We provide the servers, not the games.
- You can cancel anytime. No hard feelings.
- Don’t use our servers to do anything illegal or harmful.
1. Who We Are
GamersHut is a game server hosting service operated by GamersHut LLC (“GamersHut,” “we,” “us,” or “our”), a limited liability company registered in the State of Colorado with its principal place of business in Denver. By creating an account or using our service, you’re entering into an agreement with GamersHut LLC under these Terms of Service (“Terms”).
If you don’t agree with these Terms, please don’t use GamersHut.
2. Eligibility
- You must be at least 13 years old to create a GamersHut account.
- If you’re between 13 and 18, you confirm you have your parent or guardian’s permission to create an account and subscribe, and that they’re aware of the recurring charge to the payment method used.
- By using GamersHut, you confirm that the information you provide is accurate and that you have the right to enter into this agreement.
3. Your Account
- You’re responsible for keeping your login credentials secure. Don’t share your password.
- You’re responsible for all activity that occurs under your account.
- One community covers up to 5 people (you + 4 friends).
- Notify us immediately at [email protected] if you suspect unauthorized access to your account.
4. Early Access Program
GamersHut is currently in Early Access. This means:
- The service is functional and intended for real use, but you may encounter bugs, downtime, or rough edges.
- We may occasionally need to take servers offline for maintenance or upgrades with little notice.
- Your feedback during this period directly shapes the product, we want to hear from you! Keep in touch with us in our Discord server.
By subscribing during Early Access, you understand and accept that the service is still maturing. We’ll communicate changes via email and Discord as appropriate.
5. Subscriptions & Billing
Pricing: $20/month for access to all live games on GamersHut.
Early Access discount: Your first month is 50% off ($10). After your first billing period, your subscription automatically renews at the standard $20/month rate. We’ll send you a reminder email before your first full-price renewal.
Automatic renewal: Subscriptions renew automatically on the same date each month unless you cancel. By subscribing, you authorize GamersHut and our payment processor, Stripe, to securely store your payment method and to automatically charge it for each recurring renewal without requiring you to re-enter payment details or approve each individual charge. This keeps your servers running without interruption.
Payment processing: All payments are processed securely by Stripe, Inc. We never store your full card details. By providing payment information, you also agree to Stripe’s Terms of Service.
Failed payments: If a payment fails, we’ll notify you by email and attempt to retry the charge. You’ll have a grace period before your account is suspended. After suspension, we don’t guarantee data retention, but we’ll generally keep your saves and server data until you ask us to delete them (See Section 10). You can always request your data by contacting us at [email protected].
Price changes: If we change the subscription price, we’ll notify you by email between 7 and 30 days before the price change takes effect, along with how to cancel.
6. Cancellation & Refunds
Cancelling: You can cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period, you’ll keep full access until then. We don’t delete your saves immediately upon cancellation (see Section 10) but we do recommend downloading them prior to your subscription ending.
Refunds: As a general rule, we don’t offer prorated refunds for partial months. However, we’re reasonable:
- If you were charged due to a technical error on our end, we’ll refund you in full.
- If you contact us within 7 days of a renewal charge and haven’t used the service, we’ll generally issue a refund.
- If GamersHut experiences a significant, prolonged outage during a billing period, we’ll assess credits or refunds on a case-by-case basis.
To request a refund, email [email protected] with your account email and reason. We will review your request and get back to you as quickly as possible.
7. What We Provide
GamersHut gives you:
- Private game servers for our supported list of games for you and up to 4 friends
- One persistent server address (
play.gamershut.net) providing private routing to your specific server based on GamersHut.net login - Automatic game save management
- Automatic server management based on the game being played (see Section 10)
- A dashboard for managing servers and save files
What we don’t provide: The games themselves. You and each of your invited friends must each own a legitimate, licensed copy of any game you want to play together. GamersHut is a server hosting service, not a game distributor.
8. Acceptable Use
GamersHut servers are for you and your friends to play games together. You agree not to use our service to:
- Host, distribute, or use cheats, exploits, or hacks that harm other players in online games
- Conduct or facilitate DDoS attacks, port scanning, or any attacks against other servers or networks
- Host or distribute malware, viruses, or harmful code
- Mine cryptocurrency or run computational workloads unrelated to gameplay
- Store, distribute, or transmit illegal content, including but not limited to content that infringes copyright or constitutes child sexual abuse material (CSAM)
- Violate the terms of service of any game publisher whose games you play on our servers
- Harass, threaten, or harm other users
- Attempt to gain unauthorized access to our systems or other users’ accounts
- Reverse engineer, decompile, or otherwise attempt to extract source code from our platform
- Resell or sublicense access to GamersHut servers without our written permission
Violations of this section will result in immediate account termination and may be reported to law enforcement as legally required.
9. Game Publisher Compliance
You are responsible for complying with the terms of service of any game you play on GamersHut servers. We are not affiliated with, endorsed by, or in partnership with any game publishers whose games are supported. GamersHut provides server infrastructure only.
10. Servers & Your Data
To support our entire games library without per-server fees, game servers that have no players connected may automatically pause after a period of inactivity. Upon inactivity, we back up your save data automatically to secure off-site storage. When you or a friend reconnects, your server automatically resumes and your save data backup is restored. This process typically occurs in less than a second, however especially during early access some delays during periods of high load may occur as we actively improve this behavior.
Your game saves and server configuration are stored using globally distributed Tigris object storage. We back these up regularly, but we recommend keeping your own local backups for anything irreplaceable, especially during Early Access.
- Active subscription: Your saves are always available, whether your server is active or hibernating.
- After cancellation or payment failure: While we do not guarantee data retention after cancellation, we may store your saves and server data for a period of time to allow you to resubscribe and pick up where you left off. Contact us at [email protected] to retrieve these files.
- Deletion: You can request that we permanently delete your account and associated game saves at any time by emailing [email protected], and we’ll process your deletion, generally within 30 days.
11. Intellectual Property
GamersHut, its logo, branding, and software are the intellectual property of GamersHut LLC. You may not copy, reproduce, or use our branding without written permission.
Any content you create within games (e.g., your Minecraft builds, Valheim worlds) belongs to you, subject to the terms of the game itself. By uploading it, you give us permission to store, back up, and transmit it as needed to provide the service.
12. Uptime, Reliability & Service Changes
We work hard to keep your servers running reliably. However:
- We do not guarantee a specific level of uptime or availability during Early Access.
- We may perform maintenance that results in temporary downtime. We’ll provide advance notice when possible via Discord and/or email.
- We may add, modify, or remove supported games. If a game you’re actively using is removed from the platform, we’ll give you reasonable advance notice.
- We may modify or discontinue features of the service. Material changes that reduce what you’re paying for will come with reasonable advance notice and the option to cancel.
13. Disclaimers
We’re in Early Access, so things won’t always work perfectly. Servers might go down, saves could hiccup, a game update might temporarily break something. We’d rather be upfront about that than promise more than we can deliver right now. To the extent permitted by law, GamersHut is provided “as is” and “as available,” with no warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement, and we don’t guarantee the service will be uninterrupted, error-free, or free of bugs.
Nothing in this section affects any rights you may have under applicable consumer protection law.
14. Limitation of Liability
If something goes wrong, the most we’d owe you is whatever you’ve paid us in the 3 months before the issue happened. To the extent permitted by law:
- GamersHut’s total liability to you for any claim arising out of or relating to this agreement will not exceed the amount you paid us in the 3 months prior to the event giving rise to the claim.
- We are not liable for indirect, incidental, consequential, or punitive damages, including lost data (such as game saves), lost profits, or loss of goodwill.
- We are not liable for issues caused by third-party games, game publishers, or platforms.
Some jurisdictions do not allow certain liability limitations. In those cases, our liability is limited to the maximum extent permitted by local law.
15. Indemnification
If your actions while using GamersHut cause legal trouble for us: say, hosting something illegal on a server, you agree to defend, indemnify, and hold harmless GamersHut LLC and its team from any resulting claims, damages, or expenses (including legal fees), to the extent they arise from your violation of these Terms or your misuse of the service.
16. Dispute Resolution
We’d like to resolve any issues directly before escalating. If you have a concern, email [email protected] first and give us 30 days to address it.
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.
17. Termination
By you: Cancel your subscription at any time from your dashboard. These Terms survive termination to the extent necessary to resolve any outstanding matters.
By us: We may suspend or terminate your account if you violate these Terms, particularly the Acceptable Use section. For most violations, we’ll give you a warning and an opportunity to fix the issue. For serious violations (illegal content, attacks on infrastructure), we may terminate immediately without notice.
Upon termination, your right to access the service ends. We’ll handle your data per our Privacy Policy and Section 10 above.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we’ll notify you by email at least 14 days before the changes take effect. Continued use of GamersHut after that date means you accept the updated Terms. If you don’t agree, you may cancel your subscription before the changes take effect.
19. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GamersHut.
- Severability: If any provision of these Terms or our Privacy Policy is found to be unenforceable, the remaining provisions continue in full force.
- No waiver: Our failure to enforce any provision of these Terms doesn’t waive our right to do so in the future.
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
